accordance with the provisions of Article 80 of the Law shall be classified into flight prohibited areas (over which the flight of aircraft is absolutely prohibited)and flight restricted areas (over which the flight of aircraft is prohibited under certain conditions)and shall be so designated by Notification.

 

(Minimum Safe Altitude)
Article 174. The minimum safe altitude for an aircraft under the provisions of Article 81 of the law shall be as follows:
(1)In the case of an aircraft flying under visual flight rules: the altitude from which the aircraft can land, when its propulsion components alone have ceased to function during flight, without causing any danger to persons or objects on the ground or on the water, or any of the following specified altitudes, whichever is the higher altitude:
a)Over areas with a high density of people or houses, the altitude of 300 meters above the top of the highest obstacle within a horizontal radius of 600 meters from the aircraft;
b)Over areas with a low density of people or houses, and over unobstructed areas of water, the altitude at which the flight can be maintained at a distance of 150 meters or more above people or objects on the ground or on the water
c)Over the areas other than those specified in a)and b)above, the altitude of 150 meters or more above the ground surface or water surface.

 

2. In the ease of an aircraft flying under instrument flight rules, the altitude specified by Notification.

 

(Permission for Flight at Minimum Safe Altitude)
Article 175. Any person who intends to obtain permission under the provisions of Article 81 of the law shall submit to the Minister of Transport an application describing the following items:
(1)Name and address;
(2)Type of aircraft, the nationality and registration mark of the aircraft;
(3)Summary of flight plan (indicating clearly the purpose, date, route and altitude of the flight);
(4)Reasons for engaging in a flight at an altitude below the minimum safe altitude;
(5)Name and qualifications of pilot;
(6)Names of persons accompanying the pilot during the flight, and thepurpose of said accompaniment during the flight;
(7)Other referential matters.

 

(Exceptions for Search or Rescue)
Article 176. The aircraft specified in Ordinances of the Ministry of Transport
